What ERISA Bond coverage includes
Federal law requires anyone who handles 401(k), pension or welfare plan money to be bonded for at least 10% of plan assets.
- Required by ERISA - Meets the bonding rule under ERISA section 412.
- Plan asset protection - Covers theft or fraud of plan funds by fiduciaries.
- Form 5500 compliance - Lets you answer yes on the bonding question.
- Multi-year terms - Three-year terms lock in a low premium.
- Inflation guard - Optional automatic increase as plan assets grow.
Good to know: the bond must equal at least 10% of plan assets (minimum $1,000, maximum $500,000, or $1M for plans holding employer stock) – many owners buy three years at once.
Not covered: fiduciary mistakes that are not theft (that needs fiduciary liability) and losses to the employer rather than the plan.
